Following the submission of their amicus brief, on May 15, 2025, HRP Director Professor Gerald L. Neuman, along with Professors Kristin Collins and Rachel Rosenbloom, published an opinion piece. “Another Reason Trump’s Birthright Citizenship Order is Unlawful” critiques President Trump’s Executive Order No. 14,60, which denies birthright citizenship to children born in the United States unless one parent is a U.S. citizen or lawful permanent resident. The op-ed argues that the executive is not only unconstitutional under the Fourteenth Amendment, but also violates the overlooked federal birthright citizenship statute, 8 U.S.C. § 1401(a). The op-ed provides important historical context for the statute and explains that Congress intended the statute to guarantee citizenship to almost everyone born in the U.S., regardless of their parents’ legal status.
